Welcome to PlayMath.org! These Terms of Service ("Terms") are a legal agreement between you and Play Math, Inc. ("PlayMath," "we," or "us"), the company that operates PlayMath.org (incorporated in Delaware and headquartered in California, USA). By accessing or using the PlayMath.org website and its free math games and services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.
Parents and Guardians: If you are a parent, guardian, or educator, please review these Terms and our Privacy Policy. By allowing a child to use our Services, you agree to these Terms on the child's behalf and take responsibility for supervising the child's use. If you are under 18, you should only use the site with the permission and supervision of a parent, guardian, or teacher.
General Audience (Including Children): PlayMath.org is an educational site designed for a general audience, including children. We welcome users of all ages. Children under 13 are allowed to use our free games without creating an account or providing personal details. However, if you are under the age of 13, we recommend using the site under the guidance of a parent, guardian, or teacher to ensure you understand and follow these Terms.
No Accounts or Purchases: You do not need to register an account or provide any payment to use PlayMath.org. The Services are free to use and contain no advertising, so both kids and adults can enjoy our math games in a safe environment.
U.S. Law: By using our Services, you agree to comply with all applicable laws and regulations. Our site is operated in the United States and is subject to U.S. law. We make no representation that the Services are appropriate or available for use outside the U.S. If you access PlayMath.org from other jurisdictions, you are responsible for following your local laws in addition to U.S. law.
What We Offer: PlayMath.org provides fun, educational math games and activities for children. Our goal is to offer a safe, ad-free online environment where kids (and learners of all ages) can practice math skills through play. All games and content on our site are provided by Play Math, Inc. or by our partners under license. We continually update our game library and features to improve the user experience.
Free and Ad-Free: The Services are completely free. We do not show any third-party ads or require any in-app purchases. There are no hidden fees and we will never ask for credit card information. You can enjoy all our games without interruptions or payment.
No Registration Required: We do not require users to sign up, create accounts, or log in to play our games. You can start playing immediately. Because there are no user accounts, we do not ask for usernames, passwords, or profile information from children or any users.
Limited Communication Features: Our site does not include social features like public forums, chat rooms, or the ability for users to post content visible to others. The only interactive feature where you might provide information is through basic forms (for example, a contact/feedback form or an email submission to reach us). These are entirely optional and are used solely for you to communicate with us or ask questions. You cannot upload files, post public comments, or share content on PlayMath.org beyond sending us a direct message through those forms.
Service Updates: We may add, change, or remove content (such as adding new games, updating levels, or removing older games) to keep our Services up-to-date and enjoyable. We reserve the right to modify or discontinue any part of the Services at any time. If we do so, we will try to make sure that changes enhance the user experience. Your use of the Services after changes are made means you accept those changes. (We describe how we handle updates to these Terms in the "Changes to Terms" section below.)
Your privacy is very important to us. We are especially committed to protecting children's privacy. Our Privacy Policy explains in detail what information we collect and how we use it. Here is a summary of our practices relevant to these Terms:
By using our Services, you agree to our data practices as described here and in our Privacy Policy. We encourage parents and users to read the full Privacy Policy for more information on how we handle data.
We want PlayMath.org to be a safe, positive, and fun place to learn. By using our site, you agree to behave responsibly. Specifically, you agree not to:
If you violate any of the above rules or engage in conduct that we consider harmful, illegal, or disruptive, we reserve the right to take action. This can include suspending or blocking your access to PlayMath.org (for example, blocking an IP address) and, if necessary, informing law enforcement or other authorities. We hope never to have to do this, so please use the site responsibly.
As noted, PlayMath.org does not have forums or areas for users to post public content. However, you might submit content to us directly in a limited way, such as:
When you submit any content or communication to us (collectively, "Submissions"), you agree to the following:
We appreciate your feedback and input! It helps us make PlayMath better. Just remember that by sending us any content, you agree to these rules and to our right to use the content. If you have any questions about sending us content, feel free to contact us for clarification.
All content on PlayMath.org is protected by intellectual property laws. Here's what that means for you:
We value creativity and intellectual property. If you believe any content on PlayMath.org infringes your (or someone's) copyrights or other rights, please let us know via our contact email so we can investigate and address the issue.
Use at Your Own Risk: PlayMath.org and all Services and content provided through it are offered "as is" and "as available." We want our site and games to be awesome, but we cannot make any guarantees. You use our site at your own risk.
To the fullest extent permitted by law, Play Math, Inc. disclaims all warranties and representations of any kind, whether express, implied, or statutory. This includes (but is not limited to) implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. In more everyday language, we do not promise that:
No Professional Advice: The content on PlayMath.org (like explanations or tips in games) is for educational and entertainment purposes. While we strive for accuracy in math and learning content, it should not be taken as professional educational or tutoring advice tailored to any individual. Always use your own judgment (or a professional's advice) for important decisions.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not fully apply to you. But in such cases, our warranties are limited to the maximum extent permitted by law.
Limited Liability: Under no circumstances will Play Math, Inc. or its directors, officers, employees, agents, partners, or content providers be liable to you for any indirect, incidental, special, consequential, or punitive damages resulting from your use of (or inability to use) our Services. This includes, for example, damages for lost profits or data, or other similar damages, even if we have been advised of the possibility of such damages.
In plain terms: We are not responsible if using PlayMath.org causes you some harm or loss, beyond what the law requires. We expect your experience to be positive, but if something goes wrong, your remedy is to stop using the site.
No Liability for Certain Types of Loss: Specifically, we will not be liable for any loss or damage that results from: mistakes, errors, omissions, or inaccuracies in our content; any interruption or cessation of the Service; any bugs, viruses, or malicious code transmitted through the Service by third parties; or any user-submitted content (though, as noted, our site currently doesn't have user posts visible to others).
Maximum Liability: If, despite the above, we are found liable to you for any reason, then to the extent permitted by law our total liability will be limited to at most the amount you have paid us to use the Service. Since our Services are free, in most cases this amount will be $0. In any case, we will not be liable for any amount greater than one hundred U.S. dollars (USD $100.00). Some jurisdictions do not allow such limitations, so this cap may not apply to you to the extent prohibited by law.
Your Responsibility: You agree that you use PlayMath.org with understanding of these Terms. If you are dissatisfied with any part of the Service or with any of these Terms, your sole and exclusive remedy is to discontinue use of the Service.
The limitations above apply to the fullest extent permitted by applicable law. We do not seek to exclude liability for gross negligence, willful misconduct, or other liabilities that cannot be excluded under law.
We may update or modify these Terms from time to time. This might happen, for example, if we add new features to the site, if legal requirements change, or if we need to clarify our policies. When we make changes, we will:
We hope to keep our Terms fair and clear. If you have any questions or concerns about any update, you can always reach out to us (see Contact Information below).
Because we don't have user accounts, you are free to stop using PlayMath.org at any time. Likewise, we reserve the right to suspend or terminate your access to the Services at our discretion, without advance notice, if we believe you have violated these Terms or if we believe it's necessary for security reasons, legal compliance, or to protect our rights or other users.
Examples of situations where we might terminate or restrict access include: violating the User Conduct rules (e.g., attempting to hack the site), using the site in a way that could harm others, or other misuse of the Services. Termination can also include cases where we decide to discontinue the Service entirely (for example, if we shut down the website in the future).
If we terminate your access due to a breach of these Terms, you may not attempt to use the Services again without our permission. Even after termination, the provisions of these Terms which by their nature should survive (such as Intellectual Property, Disclaimers, Limitation of Liability, Governing Law, etc.) will remain in effect.
Remember, because the site is free and does not require registration, termination in most cases simply means we might block your device or IP address from accessing the site if necessary. We hope never to do this, as we want everyone to enjoy math, but we must ensure the site remains safe and functional for all users.
These Terms and your use of PlayMath.org are governed by the laws of the United States of America and the laws of the State of Delaware, without regard to its conflict of law principles. This means that if there is a dispute or claim arising out of these Terms or your use of the site, it will be resolved under U.S. law (specifically Delaware state law, to the extent state laws apply).
Jurisdiction: You agree that any disputes or claims will be resolved in the appropriate courts of the United States. Play Math, Inc. is based in the U.S., and any legal action concerning our Services falls under U.S. jurisdiction. In most cases, disputes will be brought in state or federal courts located either in Delaware (our state of incorporation) or in California (where we are headquartered). We reserve the right to specify the venue of any dispute, but in all cases U.S. law will apply. By using the site, you consent to the personal jurisdiction of U.S. courts for resolving any such disputes.
Dispute Resolution: We truly hope to never have a serious dispute with our users. If you have any concern or dispute with PlayMath, we encourage you to contact us first to try to resolve the issue informally. Often, a quick chat or email exchange can clear up misunderstandings. However, if a legal claim arises, it will be subject to the laws and jurisdiction described above.
International Use: We recognize that our website might be accessed from outside the United States. If you use PlayMath.org outside the U.S., you do so on your own initiative and are responsible for compliance with local laws. Please be aware that by using our Services, you are agreeing to U.S. laws and jurisdiction as noted. We make no representations that the content of the site is appropriate or available for use in other locations.
